David Kelly Homebuyer Rebate Program Terms

These terms describe the advertised David Kelly Homebuyer Rebate. Participation and the final rebate require a separate written rebate agreement applicable to the transaction.
1. Rebate amount
Subject to these terms and the written rebate agreement, the advertised rebate is an amount equal to 0.25% of the final purchase price of the qualifying Maryland residential property.
2. Who the program is for
The program is intended for consumers purchasing residential real estate in Maryland who retain David L Kelly Jr. as their buyer’s real-estate agent through RE/MAX Solutions under the applicable written buyer representation agreement and written rebate agreement. There is no occupational or income requirement for the advertised program.
3. Closing required
No rebate is earned merely by registering, contacting David Kelly Homes, signing an agreement, touring property, or submitting an offer. The qualifying purchase must close, and all applicable program and transaction requirements must be satisfied.
4. Source and availability
The rebate is funded from real-estate compensation associated with David’s representation of the buyer in the qualifying transaction. It is not a charitable grant, government benefit, down-payment-assistance program, or payment for referring another consumer. The rebate is subject to sufficient real-estate compensation being available from the transaction and to the terms approved by the brokerage.
5. Written agreement and disclosure
The rebate must be documented in writing. It may be disclosed to the seller, lender, settlement provider, brokerage, and other transaction participants as appropriate or required. The written rebate agreement controls if these website terms differ from the transaction-specific agreement.
6. Lender and loan-program requirements
The buyer is not required to use a particular mortgage lender to participate in this program. The amount, form, timing, or availability of a rebate may be affected by lender underwriting, loan-program rules, closing-cost limitations, settlement requirements, or other requirements applicable to a particular transaction.
7. Settlement
The intended treatment is for the rebate to be handled through the real-estate transaction at closing in a manner approved for the transaction and properly disclosed. The exact treatment may depend on the lender, settlement provider, brokerage, and applicable requirements.
8. Maryland only
The advertised program applies to qualifying residential purchases in Maryland represented by David L Kelly Jr. through RE/MAX Solutions. It is not an offer for transactions outside Maryland.
9. Compensation is negotiable
Real-estate brokerage compensation is fully negotiable and is not set by law. Nothing on this website represents that any particular commission or compensation amount is standard, customary, or required.
10. Changes and transaction-specific terms
The program may be modified or discontinued for future clients or transactions, subject to existing written obligations. Eligibility for a particular transaction is determined under the written agreements applicable to that transaction, not solely from an online calculator or advertisement.
